End User Licence Agreement – Faderhand
Effective from 22 September 2026.
1. Who we are and what this covers
Licensor: BcA. Tomáš Jochmann, DiS., a sole trader trading as Baracca Records, company ID (IČO) 88364101, Dvorecké náměstí 403/4, 147 00 Prague 4, Czech Republic. Contact: info@baraccarecords.com, https://www.faderhand.com.
Software: the Faderhand audio plugin in VST3, Audio Unit and AAX formats and the standalone application for macOS, and in VST3 format and the standalone application for Windows, including its documentation and any updates the licensor releases (the “Software”).
User: the person or organisation that bought the Software or uses it with the licensor’s permission (“you”).
By installing, activating or using the Software you accept this agreement. If you do not accept it, do not install or activate the Software.
2. Licence
2.1 Once the price is paid, the licensor grants you a non-exclusive, perpetual licence to use the Software as set out in this agreement.
2.2 One licence may be activated on up to 3 computers that you use. You can deactivate a computer at any time and use the activation on another.
2.3 You may use the Software for private and commercial work. Recordings, mixes and other works you make with the Software belong to you; the licensor has no rights in them.
2.4 You may transfer the licence to another person if you first deactivate all your computers, stop using the Software, and tell the licensor so the licence can be reassigned. The new user must accept this agreement.
3. Activation and licence data
3.1 The Software must be activated once with a licence key. Activation needs an internet connection; after that the Software works offline. The Software never checks the licence over the internet while it is processing audio.
3.2 On activation the licence key, an anonymised computer identifier and the Software and operating system versions are sent to the licensor’s server. The name and e-mail address in the licence are shown in the Software. The Privacy Policy has the details.
3.3 If the activation server is ever shut down permanently, already activated computers keep working and the licensor will provide a way to activate without the server. Beyond the statutory obligations in 5.1, this does not commit the licensor to releasing further updates.
4. What you may not do
- distribute, rent, lend or share the Software or licence keys with anyone the licence has not been transferred to under 2.4;
- circumvent or remove activation or the computer limit;
- modify, decompile or reverse engineer the Software, except where the law expressly allows it;
- remove copyright notices or third-party licence notices.
5. Updates
5.1 Bug fixes and updates needed for the Software to keep conforming to this agreement are free for the period required by law.
5.2 Updates within major version 1.x are free. A new major version (2.0 and later) may be paid.
5.3 If you do not install a necessary update, the licensor is not responsible for a defect caused solely by not installing it.
6. System requirements and defects
6.1 Current system requirements are published at https://www.faderhand.com and in the manual.
6.2 If you are a consumer, you have the statutory rights for non-conforming digital content under the law of the Czech Republic (Civil Code, section 2389a onwards) and of your country of residence. A defect that existed when the Software was supplied can be claimed within two years. Nothing in this agreement limits those rights.
6.3 If you are not a consumer, the Software is provided as is, and the licensor gives no warranty that it is fit for a particular purpose.
7. Liability
7.1 The Software processes audio in your productions. Back up important projects before working on them.
7.2 Towards businesses the licensor’s liability for damage is limited to the price paid for the licence. Liability for damage caused intentionally or by gross negligence, and for harm to health, is not limited.
7.3 Towards consumers liability is limited only as far as the law permits.
8. Third-party software and trademarks
The Software includes third-party components (among them JUCE, the VST3 SDK, the AAX SDK and fonts under the SIL Open Font License). Their licences are listed in the THIRD-PARTY-NOTICES file installed with the Software. VST is a trademark of Steinberg Media Technologies GmbH. Audio Unit and macOS are trademarks of Apple Inc. Windows is a trademark of Microsoft Corporation. AAX and Pro Tools are trademarks of Avid Technology, Inc.
9. Termination
If you materially breach this agreement (in particular section 4) and do not remedy the breach after being notified, the licensor may terminate the licence and block the licence key. After termination you must stop using and uninstall the Software.
10. Governing law and disputes
10.1 This agreement is governed by the law of the Czech Republic. If you are a consumer living in another country, you keep the protection given to you by the mandatory law of that country.
10.2 Consumers may use the out-of-court consumer dispute resolution body in the Czech Republic, the Czech Trade Inspection Authority (coi.gov.cz/informace-o-adr).
10.3 This agreement exists in Czech, English and Spanish. All versions have the same content; if they conflict, the Czech version prevails, without affecting consumers’ rights.
